Sorry I mean W4 form, the employees withholding allowance form.
W2 is a tax form that employees receive at the beginning of following year resulting from completed a W4 form provided by the employers.
W4 is a form that employer would request your friend to fill in purpose of tax withholding. If your friend has not completed one, it means the employer cannot report the employee tax under his SSN. However, some restaurant business owners who desperately wrong doing on legal document with IRS could use SSN to report taxes.
It is illegal in both ways and most of the time your friend cannot do anything about it if the employer does not keep promises on reporting tax. I dont really care about these matters because many of international students who have SSN card would run into this kind of issued and we all survived.
Your friend has to be strong on negotiation if he/she is not comfortable giving SSN to employer; your friend has to speak up. The outcome might not be as expected, he/she may not get a job. Like it said take it of leave it, most of these businesses dont hardly care about hiring because it always someone else would take the job.
I have never seen any Asian business owners would do an equal opportunity employment.
