PRIME MINISTER Samak Sundaravej yesterday declared a state of emergency in Bangkok, calling it the "softest means possible" to restore order after the deadly clash between government supporters and opponents that left one person dead and more than 40 injured. Army commander General Anupong Paochinda called a separate news conference later in which he repeatedly stressed the Army's goal of avoiding violence.
Here are the details of the state of emergency.
At 6.50am yesterday, Radio Thailand interrupted its programming to announce that the government had declared a state of emergency in Bangkok. This followed a fatal clash between opposing crowds at Makkhawan Rangsan Bridge at 1.30am.
Samak invoked the emergency decree on the grounds that disturbances had spiralled to an extent that they threatened social order, national security and democratic rule. He therefore deemed it necessary to restore normalcy as soon as possible. The prime minister appointed the Army commander-in-chief, who is in charge of executing emergency measures, to restore normalcy to the capital.
Key measures include a ban on assemblies of more than five people. Authorities have been authorised to stop any attempts to cause social disturbances, the distribution of news that could trigger panic or fear, and travel and building occupation deemed to be harmful. People can be evacuated if deemed necessary.
Citing Article 5 of the emergency decree, the government has suspended basic rights and freedoms as sanctioned by Articles 32, 33, 34, 36,38,41, 43,45 and 63 of the 2007 Constitution.
The state of emergency takes immediate effect. In the prime ministerial order No 194/2008, General Anupong has been appointed to take charge of executing emergency measures. He will be assisted by national police chief General Patcharawat Wongsuwan and First Army commander Lt-General Prayuth Chanocha.
Anupong is empowered to instruct and supervise government agencies and officials concerned to carry out measures as prescribed by the laws. He is to act under the supervision of the prime minister.
Police officers, military officers and civilian officials carrying out emergency measures are authorised to act as law enforcement authorities under the Criminal Procedural Code.
